Question:An owner wants to sell a plot from which Khums is taken out and use its money immediately, will the owner have to take the Khums out of the increase?
Answer:In the name of Allah, If the Khums year is not due, then the Khums is not required on the increase. However, The Khums of the increase is mandatory when the Khums year is due. If the plot land has a separate Khums year, the Khums of the increase is not required until the Khums year is due. Allah knows best.
Question:Is it obligatory to take out Khums from the land that is bought in order to be a graveyard, whether a year passed without burying in it, and if the Khums is to be taken out, should it be from the purchase or actual prices?
Answer:In the name of Allah, If the buyer has owned the land, Khums is mandatory, if none is buried, Khums is at the purchase price. If he has the right of burial only, he does not have to pay the Khums. Allah knows best.
Question:If Zaid bought a wasteland worth 80,000 riyals borrowed from Adnan and a year later he paid the said amount. Does he have to pay the said amount at the Khums year, or he may wait until the land is sold and the price is kept for a full year after selling the land, notifying that the land could either be for trade or for housing?
Answer:In the name of Allah, If the land is for housing, Khums is taken out once according to the purchase price. If for trade, the Khums should be taken out according to the new price and if the price rises in another year, the Khums should be taken out of the increase also and so on. Allah knows best.
Question:Zaid bought a wasteland in the amount of 50 thousand riyals in cash for trade. Should this be included in the Khums, when the Khums year is due?
Answer:In the name of Allah, the wasteland is included in the Khums at the new price as in the question because it is the same case of the goods offered in the shop. Allah knows best.
Question:Should I pay the Khums if I have to pay a loan that I have already borrowed?
Answer:In the name of Allah, when the Khums year is due, you have to take out Khums. Yes, it is permissible for you to pay your debt before the Khums year. What you pay for the debt is not included in the Khums. Allah knows best.
Question:Will the money received from the state bank be deducted by the loan if the Khums year has ended?
Answer:In the name of Allah, if all the conditions of the Khums have been met, Khums is mandatory. Allah knows best.
Question:Is it obligatory to take out Khums from the money which is paid by the government offices for Social Affairs in the Arab Gulf to the widows and divorced women?
Answer:In the name of Allah, if the women who are mentioned in the question have already set a Khums year, they should take out Khums from the surplus of the money given by the government. If no Khums year is set, the Khums will be taken out once received. Allah knows best.
Question:I have bought something for my use from the money from which Khums was taken but I did not use it until the Khums year is due. In what price should I take out its Khums?
Answer:In the name of Allah, as in the question, Khums is not required, Allah knows best.
Question:I have bought something for my use before the Khums year, but I did not use it. On the Khums year beginning, can I take Khums out in this way: I take out Khums from its current price if it was bought from the profits of the same year, and I take out Khums from the purchase price if it was bought from the profits of the last year.
Answer:In the name of Allah, If you have bought it before the Khums year with money from which Khums has been taken out, then you do not have to take Khums from it. However, if you have bought it before the Khums year with money from which Khums has not been taken out, you have to take out Khums with reference to the purchase price because you bought it for your own use. Allah Knows best
Question:My father owns a rented farm related to the Khums, but my father has very difficult physical conditions, and refuses to take out Khums of them or go to the religious scholars to know the right related to this land and has no house or place to live with my family but this farm, and now he wants to build and needs help. What is the ruling if I help him to build this house and my family to live there and pray for my family and my brothers? Notifying that my father offers me the idea of helping him build and live with them in the same farm?
Answer:In the name of Allah, It is permissible for you to help your father in what you mentioned, but the father must separate a section of the garden with the title of the Khums so that we can discharge his debt and pray to your parents, as well as you and your brothers, if you pray in the house built in the garden. Allah knows best.
