Question:My wife is pregnant and the fetus is 4 months old. The fetus has many abnormalities. Distortions in the brain, heart, bone marrow, and feet. The doctor believes that the fetus will die before birth. And my wife is in the United States where they check for deformation and she does not feel the movement of the fetus inside her. Is abortion permissible in this case?
Answer:In the name of Allah, Allah prohibits abortion in as the question and He is able to protect the child from the aforementioned disease. Allah knows best.
Question:One of our Muslim brothers got a Christian woman pregnant. She told him about the idea of abortion, so he encouraged her about this idea without knowing the ruling, because of his young age. He brought her a medicine the first time, but it did not succeed, but after that the woman herself traveled and bought a medicine and aborted during the first three or two months of pregnancy. 1- Is the man considered as the abortion initiator in this case? Is he considered as a murderer or not? 2- Is it possible that this man is going to be immortalized in Hell because of this sin, despite his repentance and remorse? 3 - Is what he's done a type of participating in the crime and the fetus may not give up its right on the judgement day? 4- Does the verse apply to the man (Whoever kills a believer deliberately, the penalty for him is Hell, where he will remain forever. And Allah will be angry at him, will curse him, and will prepare for him a terrible punishment) 5- Does seeking forgiveness and repentance guarantee that he will leave the aforementioned sin as someone who has no sin, and how does the dead fetus get satisfied and fulfill its right before the judgement day? 6 - This man desires to marry traditionally through the family, there is no specific girl, and he has exceeded thirty, but his conscience says how to allow himself to marry a pure girl and you have previously fallen into obscenity and the crime of abortion. As if he's going to cheat on the girl, so what do you advise? The man is moaning from guilt and afraid of the wrath of Allah, so please we are asking for your advice?
Answer:A 1. In the name of Allah, the woman who started using the medicine herself is the murderer. Allah knows best. A 2. In the name of Allah, if he is not the one who initiated the abortion process as the question suggested, then he does not bear the responsibility of killing. Allah knows best. A 3. In the name of Allah, the answer is known from the above. Allah is the Guide. A 4. In the name of Allah, it does not apply in the proposition of the question. Allah knows best. A 5. In the name of Allah, the answer is known from the above. Allah knows best. A 6. In the name of Allah, he should strive to marry a Muslim woman and avoid the forbidden and repent for the sin he committed. If he adheres to the conditions of repentance, then Allah would have promised forgiveness, as Allah loves those who repent and loves those who are purified. Allah knows best.
Question:If the abortion is permissible, is atonement a must?
Answer:In the name of Allah, yes it is. Allah knows best.
Question:What is the atonement for abortion?
Answer:In the name of Allah, it is the same as the atonement of the killing on purpose, if it is after entering the soul in the fetus. Allah knows best.
Question:On whom the blood money is obligatory on?
Answer:In the name of Allah, if the causer of abortion is none of the parents, then the blood money is for the parents, and if the one responsible of abortion is one of the parents, then he/ she has to pay the blood money to the other. If both parents are responsible of abortion, then they have to pay the blood money to the legal heir of the fetus. Allah knows best.
Question:Is blood money (Diyya) still obligatory even when abortion is permissible?
Answer:In the name of Allah, yes it is obligatory. Allah knows best.
Question:Does the aborting of a pregnant woman by a doctor, in response to the former's request, remove the responsibility of the doctor then the blood money must be paid by the pregnant woman?
Answer:In the name of Allah, neither the doctor nor the pregnant woman will be discharged of the responsibility, both of them are criminals. Allah knows best.
Question:What is the blood money (Diyya) of a fetus?
Answer:In the name of Allah, it varies according to the age and duration of the pregnancy. Allah knows best.
Question:Is retribution (Qasas) judged on those who deliberately abort the fetus after the soul has entered it?
Answer:In the name of Allah, retribution (Qasas) does fall, while blood money (Diyya) does not. Allah knows best.
Question:If the fetus is made as a result of adultery (may Allah forbid) is it permissible to abort it for fear of killing on the side of the woman?
Answer:In the name of Allah, abortion is not permissible. Allah knows best.
