Question:Is it permissible for me to place the Imam's share of the Khums in the shrine of any of the infallibles (peace be upon them) with the intention of paying the Imam's share?
Answer:In the name of Allah the Imam's share must be given to the qualified Mujtahid who meets all the necessary conditions. Allah knows best.
Question:A person who has a sum of Khums, and for example, there is a poor person who does not have the provision for his family and that he religiously deserves such rights; by giving him some of this money, the Awaited Imam (may Allah hasten his reappearance) will be pleased, is it permissible to give this person some of the Khums?
Answer:In the name of Allah, if the person whom you have mentioned is Sayed, you can give him for the share of Sayed ones, provided that the money will not be spent on what disobeys Allah. With regard to the payment of the share of Imam (PBUH), it is not permissible without the permission of the Shari'a Ruler directly or through his legal agent with a written permission. Allah is the All Guide and Knowing.
Question:If one pays the shares of the poor Sayed from the Khums to other poor Sayed, is this money that the other Sayed received a property of him so that he is entitled to spend it on himself or on whoever he likes, whether Sayed or non-Sayed, or he becomes authorized to spend it only on himself and on the Sayed only. In this case, is it not permissible to spend it on his wife if she is a non-Sayed?
Answer:In the name of Allah, it is not permissible to spend any of the Khums without the permission of the competent religious authority. The permissibility of the authority has allowed all the Shiites in the world to spend the shares of the Sayed, may Allah have mercy on them, and their presence, on the condition that they are twelvers –following the twelve Shiite Imams- and that they are really needy where the share of Khums that they receive will not be spent on things that disobey Allah such as shaving the beard. Sayed becomes the owner of the share of Sayed by no more than his need. Sayed can spend it where he wants within the permissible limits. Then, be advised, my son, that the Sayed or non-sayed husband is obligated to support his wife, whether belonging to the offspring of Hashim or Zahra (PBUH) or not. The agreement on the wife, as in the question, is of the duties of the Sayed. Allah is the All-Guide and Knowing.
Question:If the poor who belong to people of Hashim- is given - a man or a woman – the share of Sayed, this share will become his/her property and may spend on anyone who wants to, can this matter be applied to the Sayed women whose husband is common – non Sayed- and entitled to spend it on whomever, like sons and others?
Answer:If Sayed is in need, a poor person, he has the right to spend on the permissible acts because Khums has become his property, provided that what Sayed (man or woman) has received is not spent in disobedience to Allah, and the Sayeds should be a follower of the twelve Imams. Allah knows best.
Question:Can I use the Khums to help family members like my sister or mother?
Answer:In the name of Allah, the mother is not permissible because it is obligatory for you to support her. As for brothers and sisters, it is permissible with permission if it is the share of the imam (PBUH). The share of Sayed people, on the other hand, is permitted to directly be given, provided that all the conditions of Khums are met. Allah knows best.
Question:Is it obligatory to spend the share of Imam Al-Zaman (may Allah hasten his reappearance) and the other share on the Husseini rituals or only on the orphans? Do I have to give money to a certain party or spend it on what I have mentioned?
Answer:In the name of Allah, if what you have mentioned depends on spending from the Imam’s share, the one who has something of the right of Imam (may Allah hasten his reappearance) may ask us for permission to authorize him to spend from the amount of Khums. If it does not depend on paying some of the rights of the imam (PBUH) on what you have said, it is obligatory to have the money from your own money. Then you should know that if the share of the imam (PBUH) is spent as what you mentioned, the reward will be for the imam (PBUH), not for you Shiites, because you have spent the money of the imam, and not your own money in reviving the Husseini rituals. Allah knows best.
Question:If the father does not have money of his own to spend on those whom he should provide them with, is it permissible to give them from Khums?
Answer:In the name of Allah, he has to spend on them from his own money because it is his duty to support the one whom he provides, and not to extend his hand to the rights of Allah. So fear Allah and avoid the money of the Messenger of Allah (PBUH&HF) if you want their intercession. Allah knows best.
Question:Should I pay the Khums, if I have to pay a loan that I have already borrowed?
Answer:In the name of Allah, yes, it is permissible for you to pay your debt before the Khums year, so what you pay for the debt is not a Khums of it. Allah knows best.
Question:Are the sons of Aqeel ibn Abi Talib counted as Sayed or only those who are descendants of the lady of the women of the worlds Zahra (PBUH), her husband Imam Ali and her two sons Imams Hassan and Hussein (the best prayers and peace be upon them)?
Answer:In the name of Allah, being a Sayed means one belongs to the Great Prophet (PBUH&HF), a matter which is concerned with the children of the Commander of the Faithful from his wife Fatima Al-Zahra (PBUH), and there are special rules in the right of the one who belongs to Hashim and this title applies to all who you have mentioned. Allah knows best.
Question:One of the preachers is clothed in the uniforms of the preachers and is actually engaged in a broad media activity, and is financially sufficed so that he has the provision of his year with increase. Is it permissible for him in principle to spend on himself and his children from the share of Imam (PBUH)? If permissible, what is the permissible amount please? We would like you to answer according to fatwa of Sayed Al-Khoei (may Allah sanctify his soul) also if possible?
Answer:In the name of Allah, it is not permissible to spend the share of the imam (PBUH) even in the case of need without the permission of the Mujtahid who meets all conditions of being a Mujtahid. This was the opinion of Sayed Abu al-Qasim Al-Khoei (may Allah sanctify his soul) too. Sayed Abu al-Qasim Al-Khoei (may Allah sanctify his soul) did not allow the cleric to keep the share of Imam as the surplus of the need. Allah knows best.
