Question:A person who has a monthly salary to spend on the living things in full and has a business project from which he receives monthly profits whose profits are spent on the living things in full. He is also in debt and the capital of the project is still a debt too. Should he determine the Khums year?
Answer: In the name of Allah, yes, it is obligatory for him, because if he does not make a Khums year, he will not be able to know that the increase will be on the Khums year, even if that increase is a spoonful of salt. Allah knows best.
Question:I have given a loan to a friend and he has not paid it yet, but after a week, the year ends, do I have to take the Khums? And when he gives me after a while, should I take out the Khums?
Answer:In the name of Allah, unless the money reaches your hand, you do not have to take out the Khums. If during your Khums year, some of it left to you until the end of the Khums year, Khums should be taken out of the remaining. Allah knows best.
Question:Khums is due on someone, but he does not take out of the Khums, he took a debt and paid the Khums - must the Khums be paid by this debt during the year of profit or is considered a provision?

Question:If the Khums is lost or stolen from me during the delivery to the beneficiaries or to the representative of the Marja’ without negligence or carelessness, am I a guarantor?
Answer:In the name of Allah, If the transfer is with the permission of the religious ruler and you have no negligence, you do not guarantee it. If the transfer is without the order of the religious ruler you are the guarantor. Allah knows best.
Question:Every year at the time of the payment of the Khums, I suffer from a state of grievance because of the large amount paid to the representative, but - I thank Allah - am committed to pay the Khums annually and I overcome with sadness that this grief and may deprive me of the reward from the payment of Khums. Does this affect the rightness of the Khums in terms of reward?
Answer:There is no doubt that you have done your duty regarding such an issue. Yet, if your grievance is due to the departure of a portion of your wealth, you must know that what you have given to the Marja’ or by an honest representative is not yours. The Khums is for Imam (peace be upon him) and Sayeds. If your grief is for fear of money that it may not reach the Marja’, for example (God forbid), in the sense of doubt in the honesty of the representative, claim a receipt – with signature and stamp of the Marja’ for the Khums money that you want to pay. Then, do not you ask yourself that you did not blame some of the enemies of the Ahlulbait (PBUH) who have taken the right of Ahlulbait (PBUH) (such as Fadak) or looted the tents of al-Hussein (PBUH) or some representatives who looted the money of the imams (PBUH) as an act of disobedience. How can human have the ability to blame such people whereas he finds it hard to pay the right of Ahlulbait (PBUH)?!! Do seek forgiveness, my son, and seek Allah’s refuge to tranquilize yourself and to feel happiness for the religious rights that you have presented. Such rights are considered as the cornerstones of having the Ahlulbait’s (PBUH) intercession on the Day of Judgement. Allah knows best.

However, Khums should be taken out of benefits when he receives them immediately before they benefit from them, and this is not like the Khums that the you pay at the end of the Khums-year.
