Question:There are some institutions that are legally bound that whoever works for them at the beginning of his work is given a salary of (3) months in advance, even though he has not worked for them yet. The question: If the beginning of his Khums-year comes after a month, for example, and the money is still with him, is he obligated to take Khums in full, or only from the salary of the first month for which he worked? Is it the same ruling, if the employers paid in advance without an obligating law?
Answer:In the name Allah, be advised, my son, that the wage-earner owns the wages as soon as the contract is made, and he becomes required to work. What the hired employee took as in the question is his property. Therefore, he must pay the Khums in full and everything that is under his hand when the Khums year comes, whether it is from the salary or elsewhere. Allah knows best.
Question:We are aware that Khums is a mandatory not a recommended act the time of the Messenger (PBUH&HF) and the Infallible Imams (PBUT). However, what is the evidence that Khums continues to be mandatory after the second disciple of the Awaited Imam (may Allah hasten his reappearance)? Is there any saying by the Awaited Imam (may Allah hasten his reappearance) supporting the mandatory act of Khums after the second disciple? Are there authentic narrations proving this mandatory act, because there are many authentic narrations saying that Khums is not obligatory after the second disciple? Such books are by the eminent Shiite scholars like Sheikh Sadooq, Sheikh Mufeed and others. Kindly, clarify in detailed evidence the reality of such an issue.
Answer:In the name of Allah, first, my son, the Quran indicates the obligation of Khums. Any narration which contradicts Quran, we leave it, return it to its narrators and do not work according to it because it is contradictory to Quran. The Infallible Imams (PBUT) ordered to reject any narration that contradicts Allah’s book. Additionally, the narrations in which the nonprofessional thinks that Khums is not mandatory have certain contexts that are only understood by the people in know who are in the degree of mujtahid. These contexts indicate that some of the narrations say that Khums is permissible to certain people or at certain times or the narration is poorly authenticated. If you were from the people in the know, you should have not missed such things. You may review the research of Khums in Al-Jawahir, Al-Tanqeeh, Al-Mustamsak and other books in order to find what you are looking for, Inshallah.
Question:Do you have to take out the Khums from the capital before you start trading or investing? Or can we wait and finish till the end of the Khums year?
Answer:In the name of Allah, may you take out Khums immediately and this money - capital - have a particular Khums year when used in trade and profits. If a year has ended, Khums would be due. You may attach the capital within your imports and take out Khums from it at the end of the Khums year. Allah knows best.
Question:If you get a representativeness from the religious ruler or his delegate to deliver the Khums to his beneficiaries on the day of the Khums year, if the delivery is delayed, should I make reconciliation with the religious ruler or his delegate?
Answer:In the name of Allah, if you do not mix the money with your personal money, you do not have to make the reconciliation or the authorization from the religious ruler. If you do not separate the money of the Khums from the rest of your money, and the Khums year comes and you receive profits or spend something from your owner on yourself and your children, in this case you must reconcile with the religious ruler, because in this case you are a traitor to Allah and the right of His Messenger (PBUH&HF). Allah knows best.
Question:If I had an amount of money which is related to the Khums where it is not permissible for me to dispose of this amount until the one who deserves it receives his share of this amount. Here, do I have to contact the religious ruler. Should I seek a power of attorney from the religious ruler to spend the Khums?
Answer:In the name of Allah, you must, my son, take out the Khums and try to quickly give it to those who deserve it if you are authorized to act by the religious ruler or to deliver it to the religious ruler. After taking out the Khums, you may use your properties in the way you like. Be advised that any indulgence in the issue of the Khums affects the easiness of keeping the human away from the sins and reform of the religion in terms of religion and honor and dignity. Allah is the all Guide and Knowing.
Question:If the value of the money that to be taken Khums from for the current Hijri year (one million dinars) and its fifth (200) thousand dinars, and the remaining money will be (800) thousand dinars, is it permissible for me to spend this sum (800) before giving the (200) thousand dinars to those who deserves it?
Answer:In the name of Allah, you may act after the taking out the amount of Khums. However, you may not delay the Khums without legitimate justification. Allah knows best.
Question:I am an employee and I live on my salary, and I have no other outlet to make money. But I have a social savings fund to pay for Hajj, and the rest of the money in the savings fund is spent on other things. Should I take Khums out of it?
Answer:In the name of Allah, you should take out Khums of what you own from the Provident Fund with the availability of other conditions of the Khums. Allah knows best.
Question:We know that the Khums is a duty and not a recommended act during the time of the Prophet (PBUH) and the time of the imams (PBUH), but what is the evidence for the survival of the Khums as an obligatory duty after the second ambassador and is there a statement to the Awaited Imam (may Allah hasten his reappearance)? There are many stories that prove the necessity, as there are many accounts considered to be certain that the Khums is not obligatory after the second ambassador and these books are from the great jurists such as Sheikh Al-Sadouk and Sheikh Mufeed and others who explained to us accurate and detailed evidence and clear the reality of this requirement?
Answer:In the name of Allah, first, the verse of the Qur'an indicates the necessity of the Khums and still indicates and we reject any narration that contradicts the Qur'an. We do not do it because it is contrary to the Book of Allah and the imams (PBUH) said that the narration contradicts the book of Allah. Furthermore, in those narrations that the layman imagines that they indicate that the Khums must not have clues are understood by those of sound minds. The evidence shows that some of the narrations are the analysis of the Khums for some people or in certain times or the narration is weak. If you are one of the specialists, it should not be hidden from you, so see the Khums Hadiths in Al-Jawahir, Al-Tankeeh, Al-Mustamsak, and other books.
Question:Do I have to do Khums for the money in my bank account in case a year has passed?
Answer:In the name of Allah, if you can withdraw money and act in it whenever you want like in your pocket and you have to take out Khums, and if the money is in the bank's debt as a loan you do not have to take Khums, only when the bank returns money with the rest of the conditions of Khums. Allah knows best.
Question:Should I take out Khums of the jewelry that my father gave me during my wedding?
Answer:In the name of Allah, if you, my daughter, are committed to Khums, and you have a specific Khums year before marriage, if you use this jewelry before the new Khums year, you do not have to do Khums, even if you have a Khums year and you do not use it. If you have a Khums year and you do not use the jewelry, you have to take out Khums. Allah knows best.
